Fred and Wilma

Fred and Wilma were in their late 50’s.  They had adult children living in the family home. The children had through no fault of their own ‘failed to launch’. They did not feel like they should put the children out on the street. Fred wanted to keep the house. Wilma agreed. But, how to do this?  Generally, adult children do not qualify for support at law if they are over 18 and are not in school, but the parties both agreed to take them into account. After talking this through, the parties came up with a creative solution whereby Fred would transfer RRSPs, and some money so that Wilma could buy a modest house. The parties agreed that Fred would own 2/3rds of the family home and Wilma would remain a ⅓ owner in the home. This was a very creative solution that addressed the needs of all of the family members. This is the type of result we are looking for in mediation.
